Your licensing agreement is not confirmed until a donation is made. Your donation helps us maintain the garden and provide educational opportunities to our community. We are a registered 502-C3 non-profit organization and all donations are tax-deductible.

License Period: April 1 through March 31 (annual)
Terms and Conditions
License and Payment
A Gardener License is valid only with a signed agreement and paid plot fees. Fees are due before April 1 unless otherwise arranged. License fees will be prorated beginning after April 30.
A Gardener License is temporary for the term agreed upon by the fee paid and may be renewed each year if the gardener is in good standing.
A license is ultimately at the discretion of the Board of Directors and or the Garden Manager.
Cancellation and Refunds
A license may be canceled at any time by either party. All fees and donations are non refundable.
Right to Refuse Service
The Root 66 Garden reserves the right to refuse a license or service to any individual whose conduct is deemed harmful or inconsistent with garden policies.
Theft, verbal aggression, or physical aggression will not be tolerated and may result in immediate revocation of a Gardener License.
Compliance
Gardeners agree to comply with all policies, rules, and guidelines contained in this agreement and Exhibits A, B, and C. Failure to comply may result in termination of the license without refund.
Dispute Resolution
All disputes must first be addressed informally.
If unresolved, disputes will be submitted to binding mediation in San Bernardino County, California. Gardeners waive the right to file lawsuits except to enforce a mediation agreement.
Acknowledgment
By signing this agreement, the gardener acknowledges that they have read, understand, and agree to the terms of this Gardener License Agreement and all attached Exhibits A, B, and C.
Exhibit A
Rules and Regulations
Plot Maintenance
Gardeners must begin planting within 30 days of receiving a plot.
Plots must be kept weed free and maintained. Pathways must remain clear and safe.
Abandoned plots with no activity or communication for more than 30 days may be reassigned.
Organic Practices Only
No synthetic pesticides, herbicides, or chemical fertilizers are allowed.
Water Use
Use water responsibly and turn off taps after use.
No unattended hoses.
Plot irrigation systems must be set on timers for early morning or evening watering.
Notify management if there is a water leak.
Respect
Do not harvest or touch other gardeners’ plots without permission.
Treat all gardeners, guests, and volunteers with respect.
Notify management if there are conflicts that cannot be resolved.
Assault of any kind, verbal, physical, or sexual will not be tolerated.
Volunteer Commitment
Gardeners agree to contribute at least two volunteer hours per month toward garden upkeep.
Gardeners are highly encouraged to join Telegram, the garden communication app.
Children and Guests
Children must be supervised at all times.
Gardeners are responsible for their guests’ conduct.
Prohibited Conduct
Violence
Harassment including sexual harassment
Nudity
Drug or alcohol intoxication
Theft
Vandalism
Disruptive behavior
Trash and Waste
Remove all personal trash.
Compost only in designated bins.
No dumping household or hazardous waste.
Wood piles, trash piles, and rock piles must not attract pests.
Structures and Fencing
All structures and fencing require prior approval.
Only approved fencing materials are permitted including hardware cloth or garden wire.
Chain link fencing is not permitted.
Structures must not attract rodents or pests.
Animals
No personal pets are allowed inside the garden except approved service animals.
Do not enter animal enclosures without permission from the Director.
Bee Safety
Gardeners must follow the Bee Etiquette Guidelines in Exhibit B.
End of License
Upon leaving for any reason, all personal property must be removed within two weeks of the end of the license period. Remaining items will be considered donations.
Membership Cancellation
A Gardener License may be terminated by either party at any time. Fees and donations are non refundable.
The garden reserves the right to refuse service or a license to any individual.
Exhibit B
Bee Etiquette Guidelines
The Root 66 Garden partners with BeeRooted Bees, the official beekeeper, to maintain the garden’s healthy bee population.
Hive Area
Beehives are located in a designated apiary area that is clearly marked.
Only BeeRooted Bees personnel or authorized beekeepers may open or handle hives.
Behavior Near Hives
Do not stand directly in front of hive entrances.
Do not block bee flight paths.
Move calmly and avoid sudden movements.
Clothing and Scents
Avoid wearing perfumes, scented lotions, or strongly scented hair products.
Wear light colored clothing and avoid floral patterns or dark colors.
Do Not Disturb
Do not touch, feed, or tamper with bees or their equipment.
Keep tools and watering activities away from hive areas.
Allergy Awareness
Notify garden management if you have a bee sting allergy.
Carry prescribed emergency medications.
In emergencies call 911 immediately.
Education
Gardeners are encouraged to participate in beekeeper led tours and workshops.
Liability Disclaimer
Gardeners assume all risks related to bees and beekeeping activities.
Gardeners release BeeRooted Bees and The Root 66 Garden from liability related to bee activity
Exhibit C
Hold Harmless and Liability Waiver
Gardening and participation at The Root 66 Garden involve inherent risks including injury, illness, or property damage.
Participants voluntarily assume all risks associated with participation.
Participants release, waive, discharge, and hold harmless The Root 66 Garden, BeeRooted Bees, their officers, employees, volunteers, agents, and affiliates from all liability, claims, or damages related to participation or use of garden facilities.
Participants authorize emergency medical treatment at their expense if necessary.
